FMCSA Drug and Alcohol Clearinghouse: Queries Explained
Since 2020, every pre-employment decision for a CDL driver requires an electronic query of the FMCSA Drug and Alcohol Clearinghouse. Paper consent forms and previous-employer checks do not substitute for it.
Full vs limited queries
- Full query: required before any new driver operates. Shows all recorded violations, returns instantly.
- Limited query: annual check that a driver is not in the clearinghouse. Needs standing electronic consent, returns yes/no only.
The violation trap
A positive test or refusal stays in the database until the driver completes the return-to-duty process with a DOT-qualified SAP. Employers who skip queries face civil penalties per violation, and the driver stays legally unemployable regardless of what their resume says.
